Penalties

If the Professional Services Review Committee makes a finding of inappropriate practice against a Medical Practitioner, then the Determining Authority will determine the appropriate sanction to be imposed.

The Determining Authority may impose one or more of the following penalties;-

  1. a reprimand;
  2. counselling;
  3. repayment of Medicare Benefits; and or
  4. complete or partial disqualification from the Medicare Scheme for up to three years.

The penalties can have severe consequences upon the future of the practitioner's medical practice and his patients.

Fraud

If the Director thinks that the material before him indicates that the person under review, may, in relation to the referred services, have committed an offence that is a relevant offence within the meaning of Section 124B of the Health Insurance Act 1973, the Director may send the material to the Commission together with a statement of the matters that he thinks may have constituted the offence.
